Application for Road/Shore Road Allowance Closing

Please review the following Policies to familiarize yourself with the rules and regulations prior to getting started:

Requirements

Please ensure that your application contains the following information:

  1. Required Application Fee: $1085.00.
  2. Letter with reasons for applying for the road / shore road allowance closure.
  3. Sketch of subject lands showing location of buildings / structures, including docks, boathouses, pump houses, wells, septic, etc.
  4. Location Map showing the property in relation to surrounding area.
  5. Completed Lot Line Extension Authorization Form from the abutting property owners for shore road allowance closures or Completed Letter of Agreement from the abutting property owners for road allowance closures.

Notes for Applicant

  • There may be additional approvals (i.e., building permit, etc.) and additional fees and charges (i.e., building permit fees) associated with any encroachment approved in conjunction with this application;
  • Have your credit card ready for payment at the end of the application
    • $1030.00 application fee
  • Have your roll number and the legal description of the property prior to beginning the application. This information can be found on your Property Tax bill.

Costs

It is impossible, to calculate the exact price in advance but this should give a general idea. The following is a list of approximate costs that would be associated with the land transactions:

  1. Land costs 2022 (more particularly described in Fees & Charges By-law):
    1. OSRA (Muskoka River between Port Sydney Dam) $9.75 per sq m of unflooded area (flooding determined by survey); or
    2. OSRA (all over areas) $13.00 per sq m of unflooded area (flooding determined by survey); or
    3. ORA $7.50 per sq m or appraised value (appraisal at the sole cost of the applicant).
  2. Application fee $1,030 (to cover staff time and expenses processing the application)
  3. Legal deposit $2,500 to cover Town legal fees and Notice advertising costs
  4. Survey costs as arranged and paid for by the applicant

  • A detailed sketch or site plan, “to scale”, which clearly shows the following:
    • The location and measurements of all existing and/or proposed structures/encroachments on the benefitting property;
    • the location and measurements of all existing and/or proposed structures/encroachments on the Town’s property;
    • the distance from the structures/encroachments to the abutting lot lines and from the shore line (where applicable);
    • existing and proposed vegetation; 
    • driveways and paths; 
  • Letter with reasons for applying for the road / shore road allowance closure;
  • Location Map showing the property in relation to surrounding area.
  • Copy of registered transfer or deed detailing ownership of benefitting property; and
  • Letter of authorization if an agent is acting on your behalf (where necessary).
  • Completed Lot Line Extension Authorization Form from the abutting property owners for shore road allowance closures or Completed Letter of Agreement from the abutting property owners for road allowance closures.
